The New Homes Act and How it Impacts Landlords

A new piece of Government legislation came into effect on Wednesday 20 March and it has the potential to impact landlords.

The Homes (Fitness for Human Habitation) Act 2018 came into force after going through Parliament.

The act aims to ensure rented houses and flats are ‘fit for human habitation’, which means they have to be safe, healthy and free from things that could cause harm.

The Government has published a list of what is covered in the link at the bottom of this post.

One example of serious harm flagged up on the Gov.uk website is if the property is too cold, the tenants are unable to heat it and it affects their health.

The new act allows tenants to take landlords to court. If the court rules against the landlord, then they will be responsible for carrying out repairs and may even have to pay compensation to the tenants.

The new law applies to tenants who live in social or rented property.
